By accessing or using the ChinaTrend API (the "Service"), you ("Customer" or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.ChinaTrend ("Company", "we", "us", or "our") reserves the right to modify these Terms at any time. Changes become effective immediately upon posting. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
2. SERVICE DESCRIPTION
ChinaTrend provides an API service that aggregates trending topics from Chinese social media and news platforms, including but not limited to Weibo, Zhihu, Douyin, Bilibili, Baidu, and various news outlets. The Service includes AI-powered English translations and metadata analysis.The Service is provided through:
- Our API endpoints (chinatrend-api.up.railway.app)
- RapidAPI marketplace (rapidapi.com)
- Our website (chinatrend.carrd.co)
3. SERVICE PROVIDED "AS IS"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.3.1. No Guarantees
We make no warranties regarding:
- Data Accuracy: Information is aggregated from third-party platforms and may contain errors, omissions, or inaccuracies
- Data Availability: Source platforms may change formats, become temporarily or permanently unavailable, or block our access at any time
- Service Uptime: While we strive for reliability, we do not guarantee uninterrupted service or 100% uptime
- Translation Quality: AI translations are provided for convenience and may not be perfect or context-appropriate
- Data Completeness: We do not guarantee that all trending topics from source platforms will be captured3.2. Third-Party Platform Changes
IMPORTANT DISCLAIMER: ChinaTrend aggregates data from independent third-party platforms. We are NOT responsible if:
- Source platforms change their website structure, API, or data format
- Platforms implement restrictions, blocks, or rate limits affecting our access
- Platform terms of service change in ways that impact our ability to collect data
- Data becomes temporarily or permanently unavailable due to platform actions
- Data quality, format, or content changes due to platform modificationsWe will make commercially reasonable efforts to maintain service continuity but cannot guarantee it.
4. LICENSE AND PERMITTED USE
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business or personal purposes.4.2. Permitted Uses
You may:
- Access trending data through the API
- Use data for research, analysis, and commercial purposes
- Integrate the Service into your applications or workflows
- Display data obtained from the Service in your products4.3. Prohibited Uses
You may NOT:
- Resell, redistribute, or sublicense raw API access to third parties
- Circumvent rate limits or authentication mechanisms
- Use the Service for unlawful purposes or in violation of applicable laws
- Attempt to reverse engineer, decompile, or extract source code
- Use automated tools to abuse, overload, or disrupt the Service
- Scrape or extract data through means other than the provided API
- Claim ownership of the underlying source data from third-party platforms
- Violate the terms of service of the source platforms (Weibo, Zhihu, etc.)
5. API ACCESS AND SUBSCRIPTIONS
5.1. API Keys
- Your API key is confidential and must not be shared
- You are responsible for all activity under your API key
- Unauthorized sharing may result in immediate suspension5.2. Rate Limits
- Rate limits are determined by your subscription tier
- Exceeding rate limits may result in throttling or temporary suspension
- Rate limits are subject to change with reasonable notice5.3. Subscription Management
- Subscriptions are managed through RapidAPI
- Pricing, features, and limits may change with notice
- We reserve the right to suspend or terminate accounts that violate these Terms
6. INTELLECTUAL PROPERTY
6.1. Source Data
- Trending data and content belong to the respective source platforms (Weibo, Zhihu, Douyin, Bilibili, Baidu, etc.)
- We do not claim ownership of source data
- Source platform trademarks and names are property of their respective owners6.2. Service Content
- AI translations, summaries, and analysis generated by ChinaTrend are provided for your use under this license
- The ChinaTrend name, logo, API structure, and branding remain our property
- You may not use our branding to imply endorsement without written permission6.3. No Affiliation
ChinaTrend is NOT affiliated with, endorsed by, or sponsored by:
- Weibo, Sina Corporation
- Zhihu Inc.
- ByteDance (Douyin)
- Bilibili Inc.
- Baidu Inc.
- Any other platforms from which we aggregate dataAll platform names and trademarks are property of their respective owners.
7. LIMITATION OF LIABILITY
7.1. No Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW**, the Company shall NOT be liable for:
- Any direct, indirect, incidental, consequential, special, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Service interruptions, errors, delays, or unavailability
- Data inaccuracies, omissions, or changes
- Decisions made based on data from the Service
- Third-party platform changes, outages, or restrictions
- Security breaches affecting your API key or data
- Any damages arising from your use or inability to use the Service7.2. Maximum Liability
If liability is found despite the above, our total liability shall not exceed the amount you paid for the Service in the three (3) months preceding the claim.
8. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless ChinaTrend and its operators, affiliates, and personnel from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of applicable laws or regulations
- Your violation of any third-party rights
- Your violation of source platform terms of service
- Claims by third-party platforms resulting from your use of the ServiceIf any source platform takes action against ChinaTrend due to your use of the Service, you agree to fully indemnify us, cover all legal expenses, and compensate for any damages incurred.
9. TERMINATION
9.1. By ChinaTrend
We may suspend or terminate your access immediately, without notice, for:
- Violation of these Terms
- Abusive, fraudulent, or illegal use
- Non-payment of subscription fees
- Any reason or no reason at our sole discretion9.2. By Customer
You may terminate your subscription at any time through RapidAPI. Refunds are handled according to RapidAPI's policies.9.3. Effect of Termination
Upon termination:
- Your license to use the Service ends immediately
- You must cease all use of the Service and Data
- Provisions regarding liability, indemnification, and disputes survive termination
10. PRIVACY
We collect minimal data necessary to operate the Service:
- API usage logs (endpoint, timestamp, response time)
- Your RapidAPI user ID for authentication
- Aggregated, anonymous usage statisticsWe do NOT collect:
- Personal information from social media platforms
- Private user content

11. MODIFICATIONS TO SERVICE
We reserve the right to:
- Modify, suspend, or discontinue the Service at any time with or without notice
- Change pricing, features, rate limits, or subscription tiers
- Add or remove source platforms
- Update API endpoints or data formatsWe will make reasonable efforts to provide notice of material changes, but are not obligated to do so.
12. FORCE MAJEURE
Neither party shall be liable for failure to perform obligations due to events beyond reasonable control, including but not limited to: natural disasters, war, terrorism, strikes, internet outages, third-party platform actions, or government restrictions.
13. GOVERNING LAW AND DISPUTES
13.1. Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Your Country/State], without regard to conflict of law provisions.13.2. Dispute Resolution

The parties are independent contractors. Nothing in these Terms creates a partnership, joint venture, or agency relationship.14.6. Headings
